Terms of Service

By accessing or using Symbioen, you agree to these Terms of Service. Please read them carefully before using the website, reports, dashboards, data access, or audit services.

1. Acceptance of terms

These Terms of Service ("Terms") are between you and SIA symbioen, a Latvian limited liability company registered under unified registration number 40203754396 ("Symbioen", "we", or "us"). They govern your access to and use of the Symbioen website at symbioen.com, demo dashboards, sample reports, paid reports, custom audits, APIs, monitoring features, data access, and related services (collectively, the "Service"). By creating an account, requesting a report, purchasing an audit, accessing data, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.


2. What Symbioen provides

Symbioen provides independent data analysis, benchmarking, reports, audits, datasets, monitoring, and decision-support tools for EV charging infrastructure in European markets.

The information we provide is for informational and analytical purposes only. It is not legal, financial, investment, technical certification, regulatory compliance, or safety advice.


3. Data sources and limitations

Symbioen may use public, open, government, operator-provided, partner-provided, third-party, AFIR, National Access Point, OCPI, DATEX, and other available infrastructure data sources. We normalise, analyse, score, and interpret this data, but we do not own or control every underlying source.

We aim to provide reliable and transparent analysis based on available data. However, charging infrastructure data may be incomplete, delayed, inaccurate, inconsistent, duplicated, unavailable, or changed by third parties without notice. Symbioen does not guarantee that third-party or public source data is complete, current, accurate, certified, official, or error-free.

The Service relies on third-party infrastructure and services, including hosting, database, authentication, email, form processing, analytics, performance, and mapping providers. Their availability and functionality are outside our control and may change. Our Privacy Policy identifies providers that receive or process personal data.


4. Free demos, paid reports, and dashboards

Free website content, public benchmarks, sample reports, and demo dashboards are illustrative and may not reflect a complete analysis of any specific asset, operator, location, portfolio, or infrastructure project.

Paid reports, custom audits, dashboard access, monitoring subscriptions, and API access may be subject to additional scopes, order forms, statements of work, or written agreements. If those terms conflict with these Terms, the written agreement controls for the specific paid engagement.


5. Accounts

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at hello@symbioen.com if you suspect unauthorised access.

You must be at least 16 years old to create an account. Accounts may not be shared or transferred without our prior written consent.


6. Permitted use

You may use the Service for lawful purposes only. You agree not to:

  • Scrape, crawl, bulk download, or systematically extract data without written permission.
  • Reproduce, resell, redistribute, sublicense, or republish Symbioen content or datasets without written permission.
  • Use Symbioen content to create competing datasets, benchmarks, models, products, or services.
  • Use Symbioen content for AI model training without written permission.
  • Reverse-engineer, decompile, or attempt to derive the source code of the Service.
  • Misrepresent Symbioen data as your own or remove attribution.
  • Interfere with the security, integrity, availability, or rate limits of the Service.
  • Access the Service using automated means beyond what is expressly permitted.

7. Intellectual property

All methodologies, scoring models, benchmarks, derived datasets, reports, visualisations, dashboards, analytical outputs, software, and content comprising the Service are owned by Symbioen or its licensors unless otherwise agreed in writing. Nothing in these Terms grants you ownership rights in the Service.

You may cite limited public Symbioen content for non-commercial informational purposes if you clearly attribute Symbioen and link to the relevant page on symbioen.com. Commercial use, redistribution, republication, resale, extraction, or use of non-public outputs requires our prior written consent.


8. Benchmarks and correction requests

Benchmarks, reliability indicators, red flags, scores, and rankings are based on Symbioen's methodology and available data at the time of analysis. They should not be interpreted as definitive statements of fault, negligence, regulatory non-compliance, service quality, or misconduct by any operator, owner, asset, company, or public body.

If you believe that data shown by Symbioen is inaccurate, outdated, incomplete, or misleading, contact us at hello@symbioen.com with supporting information. We may review, correct, update, annotate, or remove information at our discretion.


9. Decisions and responsibility

Symbioen does not make investment recommendations and does not guarantee the financial, operational, regulatory, technical, safety, or commercial performance of any charging asset, company, portfolio, location, or infrastructure project. Users remain solely responsible for their own decisions, investigations, due diligence, compliance obligations, and professional advice.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.


10. Limitation of liability

To the maximum extent permitted by applicable law, Symbioen shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or decisions made in reliance on the Service.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us, if any, in the 12 months preceding the claim, or EUR 1,000, whichever is greater.


11. Subscriptions and payments

Certain features of the Service may require payment, including custom audits, paid reports, dashboard access, monitoring subscriptions, API access, or data exports. Pricing, billing cycles, delivery scope, usage rights, and cancellation terms will be presented to you at the point of purchase or in a written agreement. All fees are exclusive of VAT unless stated otherwise.

Free-tier features, sample reports, demo dashboards, and public data access are provided at our discretion and may be modified, restricted, or discontinued at any time with reasonable notice where practical.


12. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your access to the Service at our discretion, including for breach of these Terms, with or without prior notice.

Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, 10, and 13 survive termination, as do any payment obligations already accrued under section 11.


13. Governing law

These Terms are governed by the laws identified in any written order form, statement of work, or service agreement. If no governing law is identified there, these Terms are governed by the laws of Latvia, unless mandatory laws in your country of residence provide otherwise.


14. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email or by a prominent notice on the platform at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
